Lawyers for construction and infrastructure in the Dominican Republic

Contractors, developers, engineers and sureties find in VSP a firm that understands the construction contract and the bond that secures it, because our partners have underwritten construction bonds for more than thirty years.

Public and private works

Public works procurement is governed by Law 340-06 on Purchases and Contracting and its regulations, under the supervision of the Dirección General de Contrataciones Públicas, with tender procedures, bid and performance guarantees and challenge remedies. Private works are governed by the Civil Code and by the contracts the parties draft, and the builder's liability for defects in the work extends for ten years.

We advise across the whole cycle: prequalification and tender, contract negotiation, bonds and insurance, execution, changes and claims, acceptance of the work and final account.

  • Public tenders, challenges and contracts with the State under Law 340-06
  • Construction, design build, EPC and subcontracting agreements
  • Bid, performance, advance payment and latent defect bonds
  • Builders risk, liability and equipment insurance
  • Claims for changes, delay, cost overruns and suspension
  • Collection of progress certificates and enforcement of guarantees
  • Public private partnerships under Law 47-20
  • Construction permits, environmental licenses and site employment

Construction bonds

The performance bond protects the owner against the contractor's default, and claiming on it requires a precise procedure. We advise contractors on obtaining surety capacity and on the collateral and indemnities they sign, owners on how to claim correctly, and sureties on investigating the claim, completing the work and recovering against the contractor.

Foreign contractors

Construction companies from the United States, Spain and Latin America executing works in the country need a Dominican branch or subsidiary, registration as a State contractor where applicable, bonds issued by companies authorized in the country and contracts aligned with Dominican law. We assemble the whole structure and keep it compliant throughout the project.
