Lawyers for the energy sector in the Dominican Republic
The Dominican energy transition attracts capital to solar, wind, natural gas and storage projects. We advise developers, investors and lenders on concessions, incentives, contracts and security.
The sector framework
The General Electricity Law 125-01 organizes generation, transmission, distribution and trading under the Superintendencia de Electricidad and the National Energy Commission. Law 57-07 on Incentives for the Development of Renewable Sources grants duty, ITBIS and income tax exemptions to approved renewable projects. Provisional and definitive concessions, power purchase agreements and grid connection complete a project's regulatory path.
We advise developers from the provisional concession to commercial operation, and investors and banks on project diligence and financing.
- Provisional and definitive concessions before the CNE and the SIE
- Use of Law 57-07 incentives
- Power purchase agreements (PPAs) with distributors and non regulated users
- Land acquisition and leasing, easements and environmental permits
- Project financing, security and trusts
- EPC, operation and maintenance, and equipment supply agreements
- Performance bonds and construction and operational insurance
- Mergers, acquisitions and sale of projects in development or operation
Lenders and investors
Infrastructure funds and multilateral and commercial banks financing projects in the country require full legal diligence on concessions, permits, land and contracts, and properly created security. We issue the legal opinions, structure the security and coordinate with the lender's counsel in its jurisdiction.
Self generation and industrial users
Hotels, free trade zones and industries install their own generation and storage under the net metering program and the self generation rules. We advise on contracts with installers, interconnection and the applicable incentives.
