Lawyers for the insurance and reinsurance industry in the Dominican Republic
Insurers, reinsurers, brokers, adjusters and managing general agencies find in VSP a firm that knows their business from the inside, because our partners have practiced it for more than thirty years.
A regulated and growing market
The Dominican insurance market, supervised by the Superintendencia de Seguros under Law 146-02, is among the fastest growing in the Caribbean, driven by tourism, construction, credit and compulsory lines. It is also a demanding market: minimum capital by line, technical reserves, admitted investments, mandatory reinsurance with registered reinsurers, corporate governance and anti money laundering under Law 155-17.
We serve every link in the chain: property and casualty and life insurers, domestic and foreign reinsurers, brokers and agents, adjusters, managing general agencies (MGAs) and business groups that want to create their own insurer or captive.
- Formation, licensing and capitalization of insurers and reinsurers
- Registration of foreign reinsurers and reinsurance intermediaries
- Regulatory approval of policies, rates and new products
- Reinsurance treaties, facultative placements, fronting and retention programs
- Claims, coverage litigation, subrogation and recovery
- Surety: issuance, claims, recovery against principals and indemnitors
- Ongoing compliance, reporting to the Superintendencia and corporate governance
- Mergers, acquisitions, portfolio transfers and run off
Foreign reinsurers and insurers
A foreign reinsurer must enroll in the Superintendencia register for cessions from Dominican insurers to be admitted. A foreign insurer that wants to write directly in the country needs an authorized Dominican subsidiary. In both cases we prepare the complete file, act as legal representative where the law requires it and maintain annual compliance. We also advise Dominican insurers seeking capacity in London, Miami or Bermuda.
The advantage of a firm that underwrites
Our partners have founded and run a reinsurer domiciled in the country and a surety underwriting agency in the United States. We know how to read a treaty, calculate a reserve and negotiate with a regulator because we do it daily. That lets our advice anticipate what the business needs, not only what the law allows.
